While currently there is no federal law prohibiting workplace discrimination against employees based on sexual orientation, recent Supreme Court cases such as Price Waterhouse v. Hopkins, have broadened the umbrella of Title VII by holding that Title VII prohibits discrimination against a person who does not conform to traditional sex stereotypes.

Additionally, several states and municipalities have enacted legislation prohibiting an employer from terminating, suspending, demoting, failing to hire, or harassing an individual based on their perceived sexual orientation or gender identity.
